1. Acceptance of these terms

These terms and conditions govern your access to and use of the Survey Ferret website and services at surveyferret.com.au. By placing an order, creating an account, or otherwise using the platform, you agree to be bound by these terms. If you do not agree, you must not use the service.

2. Description of the service

Survey Ferret coordinates and prepares Queensland seller disclosure packs, including the documents and searches required to support a seller disclosure statement under Queensland property law. Documents in your pack are prepared from searches obtained from third-party providers, including government registries and utility authorities.

Survey Ferret provides an information and document coordination service only. We are not a law firm and nothing on the platform, in your disclosure pack, or in our communications constitutes legal advice. You should obtain independent legal advice about your disclosure obligations and any transaction you are undertaking.

3. Accounts and acceptable use

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. You must provide accurate and complete information when placing an order, including the correct property details.

• You must not use the service for any unlawful purpose or to order searches for a property you have no legitimate interest in.
• You must not attempt to interfere with, reverse engineer, or gain unauthorised access to the platform or its systems.
• You must not resell or redistribute documents obtained through the service other than as part of a genuine property transaction.

4. Fees and payment

Fees for the service are as quoted at the time of order and are payable in Australian dollars before we commence work, unless we agree otherwise in writing. Quoted fees include the cost of the third-party searches specified in your order. If a search authority changes its fees between your order and our lodgement, we will notify you of any difference before proceeding.

5. Turnaround times

Any turnaround times published on the platform or quoted to you are targets only and are not guaranteed. Delivery of your pack depends on the response times of third-party search providers and government agencies, which are outside our control. We are not liable for any loss arising from a delay in delivery.

6. Intellectual property

All intellectual property in the platform, including its software, design, branding, and content, remains the property of Survey Ferret or its licensors. Documents supplied by third-party providers remain subject to the terms of those providers. You receive a licence to use your disclosure pack for the property transaction it was ordered for, and for no other purpose.

7. Third-party information

Documents in your pack are produced by third parties and reflect the records held by those parties at the time of search. We do not verify, and cannot guarantee, the accuracy, completeness, or currency of third-party information. You are responsible for reviewing your pack and raising any apparent errors with us promptly.

8. Limitation of liability

Nothing in these terms excludes, restricts, or modifies any consumer guarantee or other right under the Australian Consumer Law that cannot lawfully be excluded. To the extent permitted by law, our liability for any claim arising out of or in connection with the service is limited, at our election, to resupplying the service or refunding the fees you paid for the affected order.

To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, or loss arising from your reliance on third-party information, from delays by third-party providers, or from your failure to obtain independent legal advice.

9. Termination

We may suspend or terminate your account if you breach these terms, misuse the platform, or fail to pay fees when due. You may close your account at any time. Termination does not affect orders already completed or fees already incurred, and clauses that by their nature survive termination (including intellectual property and limitation of liability) continue to apply.

10. Governing law

These terms are governed by the laws of Queensland, Australia. You and Survey Ferret submit to the non-exclusive jurisdiction of the courts of Queensland and any courts entitled to hear appeals from them.

11. Changes to these terms

We may update these terms from time to time. The current version will always be published on this page with its last updated date. Changes apply to orders placed after the change takes effect; continued use of the platform after a change constitutes acceptance of the updated terms.
